What documents are necessary to file a foreclosure?

In Washington State, the documents necessary to file a foreclosure are dependent upon the type of loan used for the property in question. Generally speaking, documents needed to initiate the foreclosure process include: 1. A Notice of Default and Election to Sell, which includes the property address, legal description, the amount of the loan and the name of the legal holder of the loan. 2. A copy of the mortgage or deed of trust which was used to secure the loan. 3. Written proof that the loan is in default and the outstanding balance due on the loan. Once these documents have been obtained, they must be filed with the court. This file must contain a request for a court order of foreclosure and associated documents, such as a affidavit proving ownership of the loan and a summons to bring the borrower into court. It is also important to include any additional documents that the court may require to complete the foreclosure process. Once the foreclosure file has been submitted and approved by the court, the borrower will be notified and a foreclosure sale date will be set. Before the sale date, the borrower will have time to contest the foreclosure or to try and reach some sort of settlement with the lender. If the court approves the foreclosure, the property will be sold and the lender will receive the proceeds to pay off the outstanding loan.
