What type of reports should franchisors submit to the government?
In Florida, franchisors must submit a variety of reports to the government. Some mandatory reports include the annual Franchise Disclosure Document, the Franchise Registration Statement, and the Franchise Relationship Law Disclosure. The Franchise Disclosure Document, also known as the FDD, must be presented to a prospective franchisee at least 14 days prior to signing the franchise agreement. The FDD must include information about the franchisor, the franchisee’s obligations, and the risk factors associated with the franchise. The Franchise Registration Statement must be submitted to the Florida Department of Business and Professional Regulation within 30 days of entering into a contract. It includes documentation about the franchise, such as its business operations, ownership, and representation. Finally, the Franchise Relationship Law Disclosure must be provided to a franchisee prior to signing the franchise agreement. It includes details about the franchisor, including the financial terms of the franchise, the rights and obligations of the parties, and any pre-existing disputes. In addition to these reports, franchisors may also be required to file other documents and disclosures with state authorities. Depending on the franchise agreement, they may also need to submit financial statements and other information about the franchise.
