Are game publishers required to provide refunds for faulty digital games?
In North Carolina, game publishers are not generally required to provide refunds for faulty digital games. This is due to the laws of “implied warranty and limitation of damages” in North Carolina, which state that the consumer cannot have damages or a refund if the publisher did not act with intent to damage the customer. In other words, game publishers can only be held liable for providing refunds if they knowingly sold a game that did not work or contained a malfunction. If the consumer discovered the fault after playing the game, then it is likely that the warranty will not apply. It is important to note, however, that the North Carolina Attorney General does have a consumer protection division which can mediate in the case of a faulty product. In such cases, the customer can file a complaint against the publisher and the Attorney General will evaluate the situation to determine whether a refund is warranted. However, the best course of action for consumers in North Carolina is to check the product description and customer reviews before purchasing to ensure that the game they are buying is not faulty or defective in any way. Additionally, it is also wise to save all proof of purchase in case a refund eventually becomes necessary.
