Are game publishers required to provide refunds for faulty digital games?
In Oregon, game publishers are not generally required to provide refunds for digital games that are faulty or defective. Oregon state law does generally require game publishers to provide refunds for video games that are purchased in physical stores, but does not generally require game publishers to provide refunds for digital games that are purchased online. The law in Oregon does, however, provide specific protections for consumers who purchase “goods”, which includes digital games. Under Oregon law, a consumer may be entitled to a return of the purchase price or repair of the goods if they are defective or do not conform to the contract’s description. This is usually limited to within 90 days of the purchase, and the consumer must provide proof of purchase. Additionally, Oregon also has certain consumer protection laws that may apply to digital game purchases. The Oregon Unlawful Trade Practices Act provides that businesses cannot engage in a “deceptive trade practice” when dealing with consumers. This includes selling defective digital products without disclosing the defect. If a consumer can prove that a game publisher engaged in a deceptive trade practice, then the consumer may be entitled to a refund or other legal remedies.
