Are game publishers required to have a clear refund policy?

In Virginia, game publishers are not required to have a clear refund policy, though many do. Generally, when a consumer purchases a digital game, they are agreeing to terms and conditions that state there are no refunds. This means that unless the game was bought in error, or the consumer can prove that there was a defect in the game, they are usually unable to receive a refund. There are, however, some exceptions. For example, the Virginia Consumer Protection Act (VCPA) does require that consumers be refunded if an item they purchased failed to meet certain criteria, such as merchantability, or fitness for a particular purpose. Additionally, the VCPA also states that vendors must provide a clear refund policy, which states the conditions for refunds. Therefore, while it is not mandatory for game publishers to have a clear refund policy, they must still abide by the VCPA when selling digital goods in Virginia.
