The process for appealing a contract award decision in California involves filing a Protest with the agency that made the award. The Protest must be filed within ten days of the agency’s notice of the award or within ten days of the Contractor’s knowledge of the award. This protest must be made in writing and must include the exact grounds for the Protest. If the agency does not respond to the Protest, then the Contractor can move forward with an appeal by filing a Petition with the California Department of General Services. This must be done within twenty-five days of the agency’s notice of the award or within twenty-five days of the Contractor’s knowledge of the award. The Petition must include the exact grounds for the appeal. The Department of General Services will review the Protest and Petition and issue a decision within sixty days of the date the Petition was received.
