Yes, a grandparent in the state of Washington can request visitation rights. The Washington grandparent visitation law allows grandparents to file a request with the court for reasonable visitation rights with their grandchildren. In Washington, a grandparent can only request visitation rights if there has been a change in the family structure or if the parents are no longer together (i.e., divorce, death, separation, etc.). The court will only grant a grandparent visitation rights if it considers such visitation to be ‘in the best interests of the child.’ This means that the court will consider the child’s physical, mental, and emotional health when deciding whether to grant visitation.
