What is the “best interest of the child” standard?
The “best interest of the child” standard is a legal concept used by the courts to decide what is in the best interest of a child in custody disputes. This standard is used in Washington state for grandparents rights law. The best interest of the child standard is based on a set of factors that a court considers when making a decision in a child custody case. These factors may include the physical and mental health of each parent, the child’s relationship with each parent, the child’s wishes (depending on their age), the ability of each parent to meet the child’s educational, emotional, and physical needs, the stability of each parent’s home, the ability of each parent to provide a stable environment, and any evidence of abuse or neglect. Ultimately, the court will make its decisions based on what it deems to be in the best interests of the child. It is important to remember that the court is not in the business of awarding custody based on preference or obligation. Rather, it is looking for an arrangement that is in the best interest of the child and which supports the child’s emotional, physical, and psychological well-being.
