Who is responsible for paying for a grandparent’s court costs?
In California, the responsibility for paying a grandparent’s court costs falls upon the grandparent, unless a court grants a request for the parents to pay the costs. Under California’s Grandparents Rights Law, grandparents have the right to seek visitation with their grandchild, seek placement of the grandchild, or seek custody of the grandchild. To pursue any of these, they must file paperwork in court. The Grandparents Rights Law also states that the court may order the parents to pay all or part of the grandparents court costs if it finds that the parents have the financial resources to pay and that it would be reasonable to do so. This is usually the case when the parents have a higher income than the grandparents and the court finds that the grandparents do not have the financial means to pay for the costs themselves. In any situation, the court may grant a motion for attorney’s fees and costs when it finds that the grandparents’ legal action was necessary to protect their rights as grandparents. This means that the court may order for the parents to pay for a portion or all of the legal costs incurred by the grandparents. It is important to note that courts may not order the parents to pay court costs in every case. Ultimately, the responsibility for paying a grandparent’s court costs generally falls to the grandparent themselves.
