Who is responsible for paying for a grandparent’s court costs?
In Oklahoma, both the grandparent and the other party are responsible for their own court costs when it comes to Grandparents Rights Law. When a grandparent files a petition for such rights, they will be responsible for the filing fee and any other associated costs. However, there are certain circumstances when the other party may be responsible for the grandparent’s court costs. If the court finds that the grandparent has been denied “reasonable access”, then the other party may be required to pay for the grandparent’s court costs. The grandparent would need to provide proof of their “reasonable access” to the court in order for this to occur. If the court finds that there is reasonable access, then the grandparent would be responsible for their court costs. The grandparent may also be able to receive help with their court costs if they qualify for financial assistance. Oklahoma law allows for grandparents to apply for financial assistance if they are unable to afford the court costs associated with filing a Grandparents Rights Law petition. Before requesting such assistance, the grandparent should speak with their attorney to ensure that they meet all requirements and qualifications.
