Who is responsible for paying for a grandparent’s court costs?
In Washington State, the person making the case in court is usually responsible for paying any court costs associated with the case. This usually applies to grandparents rights law cases. In cases where a grandparent seeks court-ordered visitation, it is typically up to the filing grandparent to cover all court costs. Washington State law also provides a mechanism for a grandparent to apply for a waiver of court costs and other fees associated with the case. Waivers are only granted in exceptional cases, when the court determines that the grandparent is unable to pay any court costs. If a waiver is granted, the court will waive any costs and fees associated with the case. Generally, the burden is on the grandparent to demonstrate they are unable to pay the court costs. When applying for a waiver, the grandparent is required to submit evidence of their financial situation. This can include proof of income, assets, liabilities, and other relevant financial documents. The court will make a determination about the grandparent’s financial situation and grant the waiver or decline the waiver based on the evidence provided. Though the burden is usually on the grandparent to pay for court costs in a grandparent’s rights case in Washington State, a financial waiver may be available in certain cases. To apply for a waiver, the grandparent must demonstrate they are unable to pay court costs associated with the case. The court will review the evidence and make a determination based on the grandparent’s financial situation.
