Does a grandparent have a say in decisions about their grandchild’s education, health care, etc.?

In South Carolina, the law grants certain rights to grandparents to have a say in decisions about their grandchild’s education, health care, etc. According to the state’s Grandparent-Grandchild Visitation statute, grandparents have the right to petition the court in order to be able to offer their guardianship. Once the guardianship rights are granted, the grandparent is then allowed to participate in making decisions regarding the grandchild’s education, health care, and religious upbringing. The court looks at several factors to determine if a grandparent should be granted guardianship rights including the existing relationship between the grandparent and grandchild, the wishes of the parents, and the overall best interests of the grandchild. Additionally, South Carolina also has a Grandparent Visitation statute which allows grandparents to seek visitation rights of their grandchildren. The court considers certain factors such as the existence of a close bond between the grandparent and grandchild, the grandparent’s physical and mental health, the fitness of the parents, and the best interests of the grandchild. Ultimately, this law allows grandparents in South Carolina to have a say in decisions about their grandchild’s education, health care, etc., however, visitation rights are considered secondary to guardianship rights and the court must decide if it is in the best interest of the child when deciding if guardianship rights should be granted.
