How does a grandparent enforce a visitation order?

In North Carolina, a grandparent may enforce a visitation order if the parent or guardian has not been honoring court-ordered visitation. First, the grandparent should contact the parent or guardian in writing to request that they comply with the court order. If the parent or guardian does not respond or comply within a reasonable amount of time, the grandparent can file a motion for enforcement. The motion should be filed in the county where the court order was issued and should include copies of the original court order and evidence of the parent or guardian’s noncompliance. The court may also order the parent or guardian to pay the grandparent’s attorney fees. If the parent or guardian still does not comply with the court order, the grandparent can ask the court to find the parent or guardian in contempt. If the court finds the parent or guardian in contempt, they may be ordered to pay a fine or may even face jail time. If this still does not result in the parent or guardian honoring the court order, the grandparent may file a motion for contempt and modification. This motion can request that the court either modify the court order or find the parent or guardian in contempt. If the court finds the parent or guardian in contempt, the grandparent’s visitation rights can be enforced.
