What are a grandparent's rights in cases of abuse or neglect?

In North Carolina, a grandparent’s rights in cases of abuse or neglect can be both limited and complex. Grandparent’s rights are generally subordinate to the rights of the parent, as established by the Constitution of the United States. However, if a grandparent has standing to sue in a court, they may be able to pursue legal action against someone who has caused their grandchild harm. In cases of abuse or neglect, a grandparent may have legal standing to sue if they can show the court what is referred to as “parental unfitness.” This means they have proof that the child’s parents are failing to care adequately for their child or are allowing their child to be abused or neglected. If a grandparent can make a good case for parental unfitness, the court may grant the grandparent limited custodial or visitation rights. In addition, a grandparent may have standing to sue if there is a long history of close and consistent contact between the grandparent and grandchild. This includes things like frequent visits, phone calls, and other forms of contact. The court may grant visitation rights if the grandparent can show that a deep relationship had been previously established. Finally, if the grandchild’s parents are no longer able or willing to care for the child, the grandparent may be granted temporary or permanent guardianship. This type of guardianship grants the grandparent the right to make decisions on behalf of the child. In North Carolina, guardianship rights are established through a court order.
