Yes, a grandparent can petition the court to have a grandchild medically evaluated. Washington’s Grandparents Rights Law, which was passed in 2006, grants grandparents certain legal rights to access, custody, and visitation of their grandchild when the child’s parents are unmarried or divorced. In addition to these rights, grandparents may also petition the court to have a grandchild medically evaluated. Under the Grandparents Rights Law, grandparents must demonstrate that the medical evaluation is necessary under the circumstances. Examples of circumstances that may necessitate a medical evaluation include when a grandchild is not developing at a normal rate, when a grandchild is exhibiting signs of physical, mental, or emotional issues, or when a grandchild has difficulty performing basic tasks such as bathing or dressing. If a grandparent can satisfy the court that a medical evaluation is necessary, then the court will likely grant the petition and order the evaluation. After the evaluation has been conducted, the evaluation must be reviewed by the court and a judge must decide whether the medical evaluation results merit further court action. Under the Grandparents Rights Law, the court may also order further medical evaluations or other courses of action if deemed necessary.
