Is there a time limit on how long a grandparent can have visitation with a grandchild?
In North Carolina, there is a Grandparents Rights Law that grants grandparents the right to visit with their grandchild. This law provides some protection for the grandparent-grandchild relationship, but it does not guarantee visitation rights for an indefinite period of time. In fact, the law states that the court only has the authority to grant visitation rights “for a period of time that the court deems just and reasonable under the circumstances.” So, while there may not be an exact time limit on how long a grandparent can have visitation with a grandchild, the court does not have the authority to grant visitation rights that last indefinitely. The court typically examines the best interests of the child when determining the amount of contact that is suitable for the grandparent. Factors such as the age of the child, the relationship between the grandparent and grandchild, and the child’s physical and emotional well-being are all taken into consideration. Ultimately, the court does not have the authority to grant grandparents the right to visit with their grandchild indefinitely. If the court determines that it is beneficial for the child to have contact with the grandparent, it will grant visitation rights for a period of time determined to be just and reasonable for the circumstances.
