What constitutional rights do grandparents have?
Grandparents in Texas have a few constitutional rights that have been granted through State law. These rights include the right to be given reasonable access to grandchildren, the right to file suit for a court order to have reasonable access to grandchildren, and the right to intervene in certain court proceedings involving the grandchildren. The right to be given reasonable access to grandchildren means that a grandparent can ask the court for a visitation order so that they can maintain regular contact with their grandchildren. This court order can include specific days and times, and place of meeting that will be determined by either the court or the parties involved. The second right is the right to file suit for a court order to have reasonable access to grandchildren. Grandparents may bring a suit in court to petition the court for rights to visit with their grandchildren. To qualify for this right, the grandparent must show that their relationship with the grandchild is in the best interest of the child. The last constitutional right is the right to intervene in certain court proceedings involving their grandchildren. Grandparents may intervene in court proceedings when their grandchildren are involved in matters regarding child support, custody, adoption, and termination of parental rights. This right allows grandparents to give their input on matters that involve their grandchild and help protect their best interests.
