Are grandparents allowed to challenge a parent’s decision in court?

In Oklahoma, grandparents have limited rights to challenge a parent’s decision in court. Grandparents are allowed to file a petition in court asking for visitation rights with the grandchild if there is a valid reason to do so. For example, if the grandchild’s parents have been divorced, separated, or are not living together, the grandparents may file a petition to seek visitation rights with the grandchild. In order to have the court recognize such a petition, the grandparent must establish that there would be a meaningful benefit to the grandchild if visitation was allowed. This would include showing that there is a preexisting relationship between the grandparent and grandchild and that visitation would be in the best interest of the grandchild. If a grandparent is unable to prove that a meaningful benefit exists, then the court may not grant visitation rights. The petition may also be denied if the grandparent is seeking visitation rights as a way to interfere with the established parental rights of the grandchild’s parent. In Oklahoma, there is no law that specifically grants grandparents visitation rights with a grandchild. Therefore, it is important for grandparents to work with an experienced family law attorney to ensure that any petition for visitation is handled properly.
