Does a grandparent have the right to have a say in the grandchild’s medical care?

In South Carolina, a grandparent does have the right to have a say in their grandchild’s medical care, provided that certain conditions are met. South Carolina’s Grandparent’s Rights Law specifically states that a grandparent may petition the family court for the right to consent to or refuse medical treatment for a grandchild. The grandparent must be able to demonstrate that the grandchild’s parents are unable or unwilling to give the necessary consent for medical treatment. If the court grants the grandparent the right to make medical decisions for the grandchild, then the grandparent is able to consent to and refuse certain medical treatments. When determining if a grandparent has the right to give or deny consent for medical treatment, the court considers the best interest of the grandchild. The court must also ensure that the grandparent’s rights are balanced with the rights of the parents and the child. Ultimately, if a grandparent can demonstrate that the grandchild’s parents are unable or unwilling to provide meaningful consent for the medical care the grandchild needs, the grandparent can petition the court for the right to make medical decisions for that grandchild. If the court grants the grandparent this right, then they will have a say in the grandchild’s medical care in South Carolina.
