What do grandparents need to do to prove their relationship with a grandchild?
In Texas, grandparents can seek court-ordered visitation rights with their grandchild under the Grandparents Rights Law. To prove their relationship with a grandchild, grandparents must demonstrate to the court that there was a close bond or meaningful relationship with that child. Grandparents’ relationship with the grandchild must have existed prior to the onset of the court proceedings. This means that grandparents must provide evidence of a meaningful relationship with the child such as communication through phone calls, visits, or electronic communication, or providing parental support such as providing financial support, being part of regular activities, or providing emotional support. Grandparents will also be required to provide proof of a blood relationship or evidence of adoption if the parent is not related to the grandchild. This can be done through documents such as birth certificates, death certificates, or adoption orders. Additionally, grandparents will also need to provide evidence of a changed circumstance or family disruption. This means that the grandchild needs to be affected by a familial disruption such as death, divorce, or separation of the parents, or an incapacitation of either of the parents. This evidence can be provided through court documents or medical records. If all of the evidence is provided and the court finds that the relationship between the grandparent and grandchild is legitimate and stable, they are likely to grant the grandparents visitation rights to the grandchild.
