Is a grandparent required to pay child support if they get custody of a grandchild?

In Nevada, a grandparent who has received custody of their grandchild is not required to pay child support. Grandparents may obtain legal custody of their grandchild through the state’s Grandparent’s Rights Law. This law allows grandparents to assert rights to their grandchildren if they are at least one of the following: Biological grandparent, adoptive grandparent, or have an established relationship with the child. In order for a grandparent to obtain legal custody, they must file a petition in court and prove that they are fit parents. The court will then consider various factors such as the grandparent’s financial situation, ability to care for the child, and relationship to the child. If the court finds that the grandparent is a fit parent and should have legal custody, then the grandparent would not be held responsible for paying child support. The parent who lost custody of the child would be the one obligated to pay child support. The court may also order child support payments from both the parent and the grandparent if the grandparent can demonstrate a financial need to support the child. In conclusion, a grandparent who has obtained legal custody of their grandchild in Nevada is not required to pay child support. However, the court may order a grandparent to pay support if the grandparent can prove a need to help support the child.
