What is the legal definition of a grandparent?

In Oklahoma, the legal definition of a grandparent is someone who is a parent of a parent of a child. Grandparents in Oklahoma typically have legal rights similar to those of parents, but they are limited in some ways. Grandparents may be able to obtain visitation rights, legal guardianship, or joint legal custody of their grandchildren. In order for grandparents to request visitation rights, they must show that they (1) have an emotional attachment to the grandchild they are seeking visitation with, and (2) that visitation serves the best interests of the grandchild. Grandparents may also be granted legal guardianship or joint legal custody in cases where it is deemed necessary for the protection of the child. In addition to visitation rights, grandparents may also file for custody of their grandchild in certain circumstances. Grandparents may be eligible to file for custody if one or both of the child’s parents are deceased, unable to care for the child, or if the child’s parents are unfit, or have been proven to be neglectful or abusive. In all cases, the court will evaluate the best interests of the child when determining custody or visitation rights. Grandparents should speak to a family law attorney who can provide more information and assistance regarding their legal rights regarding their grandchildren in Oklahoma.
