Does a grandparent’s financial status have an effect on their visitation request?

In Florida, the grandparent’s financial status does not have an effect on their visitation request. The Florida Statutes allow for grandparent visitation under a few different circumstances. The first being “when a court determines that visitation is in the best interest of the minor child,” which is not contingent upon financial status. The other situations for which visitation can be granted are if one of the child’s parents is deceased, if the parents are divorced, or if the marriage between the parents has been declared invalid by a court. In any of these circumstances, the grandparent may file a petition for visitation in the circuit court regardless of their financial status. The court may consider the grandparent’s financial status when determining the extent and nature of the visitation schedule. But the court may not take the financial status into account when deciding whether or not to grant the visitation. Ultimately, the court will look at the total circumstances surrounding the grandparent-grandchild relationship in order to determine if visitation is in the best interest of the minor child.
