Does a grandparent’s financial status have an effect on their visitation request?

In Hawaii, a grandparent’s financial status does not have an effect on their visitation request. Under Hawaii’s Grandparents Rights Law, child custody and visitation issues are determined based on the best interests of the child. Grandparents may request visitation with their grandchild or grandchildren if a court finds that it would be in their best interests. Grandparents may file a petition for visitation in circuit court if the parents of the child are divorced, if the child is not living with one or both of the parents, or if the parent has died. The court will then decide whether granting visitation rights to the grandparents would be in the best interests of the child. In making this decision, the court can consider several factors including the amount of contact between the grandparent and the grandchild, the grandparent’s relationship with the child, and the grandparent’s financial status. Though financial status may be taken into consideration, it is just one factor considered by the court in determining whether visitation should be granted. The court will typically consider other factors such as the grandparent’s ability to provide a supportive relationship and role to the child, the grandparent’s mental and physical abilities, and the grandparent’s geographic proximity to the child. Ultimately, the court will decide the visitation rights of the grandparent based on the best interests of the child.
