Does a grandparent’s financial status have an effect on their visitation request?

In South Carolina, a grandparent’s financial status does not have an effect on their visitation request. South Carolina has a Grandparents Rights Law that gives the grandparents of a child the right to seek visitation with their grandchild, even if the parent of the grandchild objects. The grandparent must be able to demonstrate that the denial of visitation would significantly impact the child’s wellbeing or have a negative impact on the relationship between the grandparent and grandchild. If a grandparent wishes to seek visitation in South Carolina, they do not have to have any certain financial status. However, some courts may require a grandparent to provide evidence that they can financially provide for the child if they are granted visitation. This evidence may include proof of income and/or financial stability, such as bank statements and pay stubs. Courts may also require the grandparent to prove that they are able to provide a safe and stable environment for the child if they are granted visitation. South Carolina’s Grandparents Rights Law ensures that grandparents have the right to seek visitation rights with their grandchild regardless of their financial standing. However, a grandparent may be required to provide evidence of their financial stability to a court in order to be granted visitation.
