Does a grandparent’s financial status have an effect on their visitation request?

Yes, financial status can have an effect on a grandparent’s visitation request in Texas. Texas Grandparents Rights Law allows a grandparent to seek access or possession – often referred to as visitation – of a grandchild if certain qualifications are met. The grandparent must have had sustained and significant contact with the grandchild, the grandchild must have lived with the grandparent for at least six months and one of the child’s parents must have been incarcerated, died, or the marriage of the grandchild’s parents must have been terminated during that six-month period. In addition, the court will look at the evidence presented and consider four factors when deciding if the grandparent should be granted visitation rights: their relationship with the grandchild, their purpose for requesting visitation, the effect of visitation on the grandchild, and the grandparent’s financial ability to provide for the grandchild’s needs. Courts can take into consideration a grandparent’s financial status when deciding if the grandparent should be granted visitation rights. For example, if a grandparent is financially unstable, the court may decide that visitation by the grandparent is not in the best interest of the grandchild. On the other hand, if the grandparent’s financial situation is stable and they can provide for the child’s needs, the court may grant them visitation rights. Ultimately, the court must determine the grandparent’s financial ability to provide for the grandchild’s needs before granting visitation.
