In California, the legal process for terminating a parent’s rights so a grandparent can adopt their grandchild is outlined in the California Grandparents’ Rights Law. Generally speaking, the law requires that a parent’s rights be terminated by court order before a grandparent can adopt their grandchild. A court order can be obtained through a petition that is filed in court. In order for the court to grant the petition, the grandparent needs to show that the termination of the parent’s rights is in the best interest of the child. There are certain situations in which a grandparent can adopt their grandchild without the need to terminate the parent’s rights. This is typically known as a “kinship adoption”. In order to obtain a kinship adoption, the grandparent must show that they have had a long-standing relationship with the child, and that the child has lived in the grandparent’s home for at least six months before the adoption petition is filed. In addition, the grandparent is required to comply with all of the requirements of an adoption in California, such as completing a home study and obtaining a court order. The court will ultimately decide whether or not the adoption is in the best interest of the child. If the court decides that it is, the parent’s rights will be terminated, and the grandparent will become the legal guardian of the child.
