No, there are no federal laws that grant grandparents visitation rights. However, according to the Maryland Code, Title 5, Subtitle 8 Chapters 5-801 to 5-809, a court may grant a grandparent visitation if the court finds that it is in the best interest of the child. In order for the grandparent to be granted visitation rights, the court must determine that the grandparent has established a significant and viable relationship with the child, that the grandparent has the capacity to care for the child, and that denial of visitation would affect the child emotionally and developmentally. However, in any proceeding involving a grandparent’s petition, the parents always have the final say in granting or denying visitation rights to grandparents.
