Are grandparents allowed to file for child support from the parent of their grandchild?
In North Carolina, grandparents are not allowed to file for child support from the parent of their grandchild. Grandparents are permitted to seek visitation rights, custody, or adoption of a grandchild in certain circumstances, but are not entitled to child support. Under North Carolina law, the parent of a grandchild can be required to provide financial support to their grandchild, but only if the parent has adopted the grandchild. However, even if an adoption occurs, the grandparent will not be legally allowed to file for child support. Grandparents may be able to seek financial support from a parent of their grandchild if the parent voluntarily agrees to pay child support in an agreement. The agreement must be drafted by an attorney and approved by the court. It is important to note, however, that the court will not enforce the agreement if the parent decides to stop making payments. Additionally, North Carolina does not allow grandparents to collect child support from the parents of their grandchildren through Social Security benefits. A parent may be responsible for supporting their grandchildren financially, but the grandparent is not able to seek financial assistance through the Social Security system. Ultimately, while grandparents are allowed to file for visitation, custody, and adoption rights in North Carolina, they do not have the legal right to file for child support from the parents of their grandchildren.
