How does a court case work?

A court case works in California by having both parties involved in the case, called the plaintiff and the defendant, appear before a judge. Before the actual court date, the plaintiff must file a legal document called a “complaint,” which has all the details of the case including the facts, reasons, and remedies sought. The defendant will then have the opportunity to respond to the complaint by filing a legal document called an “answer”. On the day of the court case, both parties will appear before the judge and answer questions about the case. The plaintiff will typically present their evidence first, followed by the defendant’s evidence. After both parties have presented their evidence, the judge will hear closing arguments from both sides before rendering a decision. The judge’s decision is based on both parties’ evidence and arguments. In some cases, both parties may reach a settlement before the judge renders a decision. In a settlement both sides agree to the terms of the agreement and sign a contract that the judge will enforce. Settlements are usually quicker and less expensive than going through an entire trial process. Regardless of the outcome, the court case process in California can be a long and complicated one.
