What is a discovery request?

A discovery request is a formal request for evidence, made by one party of a legal case to another party, during the pre-trial phase of the court proceedings in California. It is the process by which both sides of a case gather and exchange information and other evidence which may be relevant to the facts of the case or the potential claims or defenses that must be proven by either party. The types of evidence requested or provided could include documents, photographs, or any other tangible evidence, as well as interrogatories and depositions. The judge will determine which evidence must be provided and what can be excluded, but in general, the discovery process is intended to help both parties understand the case more thoroughly and provide more information so that they can prepare for trial and decide whether to settle the case out of court.
