What is a discovery request?

A discovery request is a legal request in which one party in a court case requests documents or other information from another party. In the US legal system, discovery requests are a way for parties to gather evidence before the trial. Discovery requests allow parties to gain access to documents or evidence they might otherwise not be able to get. In Texas, there are various types of discovery requests. Generally speaking, discovery requests allow parties to gain access to documents or other evidence that supports their case and/or that may be relevant to the trial. This can include documents, emails, videos, and other evidence. To request discovery in Texas, the party must fill in and submit a “Notice to Produce” form. This form will list the documents or other evidence the party is requesting. Then, they can serve it to the opposing party or their attorney. Once the opposing party or their attorney receives the notice, they must provide the requested documents or other evidence. Discovery requests can be incredibly useful for parties on both sides of a case. By having access to the requested documents and other evidence, parties will be better prepared for their case before it goes to court.
