What is a restraining order?
A restraining order is a legal document in Louisiana that orders someone to stay away from another person. It can be issued by a court and enforced by the police. It is commonly used to protect someone from abuse or harassment. Restraining orders can be issued for a variety of reasons. It may be used when someone is physically or emotionally abusing another person, or engage in other behaviors that threaten someone’s safety. It may also be used when someone is afraid of being stalked or harassed. When someone applies for a restraining order, they must file a petition in court and serve notice to the abuser. The person who is being restrained must be given a chance to explain why a restraining order should not be issued. Once a restraining order is issued, the person being restrained must stay away from the person who requested the order. The restraining order may also limit the person being restrained from having contact with the child or children of the person who requested the order. If someone violates the restraining order, the court may issue additional orders, such as ordering the person to pay a fine or be arrested. Violating a restraining order is a serious offense and can lead to the offender being charged with a misdemeanor or felony.
