What is an appeal?

An appeal is a legal process that allows a person to challenge a decision made by a court or other tribunal. In the state of West Virginia, an appeal is when a party to a case disagrees with either the ruling or the sentence of the court and seeks to have it changed or overturned by a higher court. An appeal is typically made by a person who believes that the ruling was unfair or that it was not based on the facts and evidence presented during the trial. During the appeal process, the higher court reviews the case and determines whether or not the original court ruling should be upheld. This is done by looking at the law and evidence presented, as well as reviewing the arguments the parties made concerning the legality of the original ruling. The higher court can either decide to uphold the original ruling or to reverse it and order a new trial. If the higher court upholds the original ruling, then the party who filed the appeal must abide by that ruling. If the court reverses the ruling, then a new trial is held to determine the outcome of the case. The party who filed the appeal does not necessarily have to be the party that wins the new trial. Appeals are an important part of the court system and allow for fairness and justice to be served. While it may take more time and money to successfully complete the process, it can be worth it if the original ruling was not based on the facts or the law.
