What is a contempt of court hearing?

A contempt of court hearing is a court proceeding in which a person is accused of disregarding or disobeying a court order. It is a form of criminal contempt, as opposed to civil contempt. In Arkansas, contempt of court proceedings are usually brought to ensure the public’s respect for the legal system. In contempt of court cases, the court must determine whether the accused has acted intentionally and with contemptuous disregard for the court order or rule. If the court finds that the accused has been guilty of contempt, the punishment may range from a fine, to imprisonment, to a combination of both. The court must also determine whether the defendant’s conduct was inadvertent or accidental. If it was not, the court may order the defendant to apologize in open court and may also impose a fine or imprisonment. If the defendant’s conduct was inadvertent, the court may order a variety of remedies designed to ensure the defendant’s obedience to the court order. When a contempt of court hearing is held, the court must provide the accused with due process. This means the court must provide the accused with the opportunity to evaluate the evidence, present their own evidence, confront witnesses, and make their own arguments. In addition, the court must provide the accused with a fair and impartial hearing.
