What is a motion for a change of venue?
A motion for a change of venue is a motion or request made in a court of law that asks for the location of the court hearing to be changed. In Louisiana, a motion for a change of venue can be made for criminal and civil court cases. In criminal court cases, it is typically used if the defendant does not feel that they can receive a fair trial in the court where the case is currently being heard, such as when the jury pool or the witnesses for the case are from the same community as the defendant. In civil court cases, it can be used if the parties of the case live in different areas. When filing a motion for a change of venue, the defendant or the party making the motion must present reasons as to why the change of venue is necessary or why it is in the best interest of the case. These reasons could include the inability to receive a fair trial due to the community or other reasons. Once the motion is filed, the court will review it and consider it before ultimately deciding whether or not to grant the motion. In some cases, the motion might be denied because the court believes that the change of venue is not necessary or in the best interest of the case.
