What is guardianship law?

Guardianship law is the legal concept that allows an individual or entity to be appointed by a court or other government agency to take care of the well-being and protection of another person who cannot do it for themselves. In New Jersey, guardianship law is set by the state and governs issues such as substituted judgment, decision-making, and medical care. The court typically appoints a guardian to look after the person who is no longer able to handle their own affairs, yet is unable to make decisions for themselves. The guardian has the responsibility to make decisions for the ward with their best interests in mind. In New Jersey, guardianship law can cover a wide range of areas. This include the physical, mental, and financial care of the ward. The guardian has the responsibility to provide medical care, ensure the ward’s safety, and look after the person’s financial and legal affairs. The guardian is responsible for obtaining consent from the ward when necessary and therefore must be familiar with both the ward and the regulations surrounding guardianship law. In New Jersey, guardianship law also provides protections for the ward. The guardian has the obligation to act in the ward’s best interest and cannot misuse funds or act in any way that would be detrimental to the ward’s safety or wellbeing. In addition, the guardian must keep accurate records of all decisions made on behalf of the ward, and must keep this information available to the court.
