How is a guardianship petition filed?

In Arkansas, a guardianship petition is filed by filing a petition in the probate court of the county in which the proposed ward resides. The petition must have the proposed ward’s name, date of birth, address, and any other relevant information. The petitioner must also include information about the reasons why a guardianship is being proposed and provide information about the proposed guardian. The petition and supporting documents should be filed with the court and copies should be served on interested parties such as the proposed guardian, the proposed ward, and any other person who may have an interest in the proposed guardianship. The court will review the petition and may require a hearing if the court finds that a hearing is necessary for the best interests of the proposed ward. At the hearing, the court will hear any objections to the proposed guardianship and decide whether to grant or deny the guardianship. If it is granted, the court will issue an order which will appoint the guardian and outline the duties and responsibilities of the guardian. The guardian must then take the necessary steps to ensure that the proposed ward is properly cared for and their rights and interests are protected.
