What is a temporary guardianship?
A temporary guardianship is a legal guardianship arrangement that is established for a certain period of time or an identified purpose. In Kansas, guardianship laws allow for temporary guardianship to be established in order to meet the short-term needs of a person, such as protecting that person during a time of illness, disability, or transition. A temporary guardianship can be set up with the help of a lawyer, and is typically granted by a court. Under Kansas guardianship laws, a parent or other guardian can petition the court to appoint a temporary guardian for the individual for a certain period of time. The temporary guardian is then granted specific rights and duties to provide care and protection to the individual. The rights and duties can vary depending on the circumstances and the individual’s needs. For example, the temporary guardian may be authorized to make medical decisions on behalf of the individual, manage finances, or provide daily care. Once the period of time or purpose ends, the temporary guardianship is dissolved. In some cases, a temporary guardianship can be utilized to help someone transition from one living situation to another. It can also be used to help someone facing a mental health crisis, or to prevent a person from being taken advantage of in vulnerable situations. In Kansas, temporary guardianships can last up to one year and may be extended beyond that if needed.
