How can a person become a guardian?
In Nevada, becoming a guardian is a complex process which requires careful consideration. The process may be started by the parents of a minor child or by a court of law. If it is initiated by the parents, they must first file a petition with the court. This must include the name, age, and address of the proposed guardian and the minor child, a statement of the reason why guardianship is being sought, and any other pertinent information. Once the petition is filed, a hearing will be held to determine whether or not the guardianship will be approved. If it is initiated by the court, they may do so in the event that a child is deemed to be in need of a guardian due to circumstances such as neglect or abuse. The court will appoint a guardian ad litem to investigate the case and to make their own recommendation on the guardianship. The court may consider any recommendations made by the guardian ad litem when deciding whether or not to appoint a guardian. In either instance, the court will review the proposed guardianship to ensure that it is in the best interests of the minor child. The court may request additional information from the proposed guardian before approving the guardianship. Once the guardianship is approved, the responsible party must be willing to abide by all provisions and terms of the guardianship. This includes providing information to the court on a regular basis.
