Who can become a guardian?
In Florida, anyone 18 or older may become a guardian of a minor or an adult with a disability. A guardian must be a U.S. citizen or a legal resident of the state of Florida. The court will look into the qualifications of the potential guardian before granting guardianship. In some cases, the court may require that the potential guardian take a class or complete some other form of training. Professionals from the court or an approved educational or counseling institution may conduct the training. In order to become a guardian, a person must pass a background check. The Florida Department of Law Enforcement (FDLE) must approve the background check before the court can grant guardianship. The background check looks for criminal or sexual offenses, child abuse, financial mismanagement, or any other misconduct. In order to be declared a legal guardian in Florida, a person must be considered to be “in good standing” with the court. This means that the potential guardian must not have any violations of the law or any outstanding court orders. The guardian is responsible for providing care and protection for the person whom they are appointed to represent. The guardian must act in accordance with the law and the best interest of the person they are appointed to care for. It is important that the person chosen as a guardian is someone who is responsible, reliable, and trustworthy.
