What is a conservatorship?

A conservatorship is a type of guardianship granted by a court. In the state of Iowa, a conservator is a person appointed by the court to manage the estate of someone who is unable to do so themselves. This person may be responsible for investing the estate’s assets, making sure bills are paid, applying for government benefits, and providing overall financial management for the estate. The conservator usually needs to provide detailed accounting of their actions to the court and the court may require the conservator to post a bond to ensure the fiduciary duties of the conservatorship are met. The court may also name a conservator for an individual who is unable to take care of their person or property as well as their finances. This type of conservatorship would involve protecting the individual’s physical safety and emotional well-being as well as their financial security. The conservator would be responsible for assuring the individual’s needs are met, such as providing for medical care and housing, helping them make decisions about their future, and protecting their assets from wasteful practices. Conservatorship is an important legal process that provides a much needed oversight and guardianship for those who may not otherwise be able to take care of their own estate or wellbeing. It is a serious undertaking and those interested in becoming a conservator should consult with an attorney for further advice.
