What is a conservatorship?
A conservatorship is a type of guardianship that involves the appointment of a person, called a conservator, to care for someone else known as a protected person. This type of guardianship is available in Kansas and generally applies to individuals who are unable to care for themselves or manage their own affairs. This can include any person who is mentally or physically incapacitated, has developmental disabilities, or is suffering from substance abuse. The court must find that the protected person is not capable of managing their own affairs and appoints a qualified person to act as their conservator. The conservator has legal authority to make decisions about the person’s care, including where the person lives, what medical treatments they receive, and how their finances are handled. The conservator may be given broad legal authority to act on behalf of the protected person. They may be responsible for managing their personal care as well as their financial, business, and legal matters. For example, a conservator has the authority to purchase and sell real estate and other assets on the protected person’s behalf. The conservator is required to act in the best interest of the protected person and provide regular reports to the court detailing their management of the person’s finances. The court must approve any major financial decisions. In addition, the conservator must act in accordance with any special instructions left by the protected person prior to the appointment of the conservator.
