What is a guardianship of the person?
A guardianship of the person is a court-ordered arrangement whereby a guardian is responsible for the care and management of another person’s life, usually due to their mental or physical incapacity. In Georgia, if a guardian is needed, the first option is to choose a family member, such as a parent, adult sibling, or other close relative. If no family member is able or willing to act as the guardian, the court may appoint a public or private guardian. The purpose of a guardianship of the person is to provide a safe and supportive environment for an incapacitated person, while protecting their legal and financial rights and managing their health care and living arrangements. The guardian is responsible for development of a plan of care for the person, including educational and medical care. They are also responsible for any decisions regarding the person’s living arrangements, medical care, and activities. In some cases, a guardian may have authority to make financial decisions or provide consent for medical treatment. In Georgia, guardianships of the person can be temporary or permanent. The duration of the guardianship depends on the individual’s needs. The courts strive to find a balance between providing protection for the person and preserving their rights and independence as much as possible. A guardianship ends when the incapacitated person passes away or recovers, or when the court determines the guardianship is no longer necessary.
