How do you remove a guardian?
In Kansas, a guardian of a minor or incapacitated person is usually appointed by a court. The court may also terminate a guardianship when it is no longer necessary. In order to remove a guardian, you must file a Petition with the court. This Petition should include information about the guardian, including their name and address, and the facts explaining why the guardianship should be terminated. The Petition must then be served on the guardian and the person for whom the guardianship was created. Once the Petition has been filed, the court will set a hearing date and the guardian and the person for whom the guardianship was created will be notified. At the hearing, the court will consider the facts and decide whether to grant the Petition and terminate the guardianship. In certain instances, the court may also appoint a lawyer to represent the interests of the person who was under guardianship. The court will also consider any objections filed by the guardian or the person for whom the guardianship was created. If the court grants the Petition, the guardian will have to make arrangements to transfer guardianship authority to the appropriate party. This could be a family member, a caretaker, or a social service agency. After the transfer has taken place, the court will issue an Order removing the guardian and terminating the guardianship.
