What are the different types of guardianship?
Guardianship law in New Jersey outlines different types of guardianships. The most common types are guardian of the person, guardian of the estate, and limited guardianship. A guardian of the person is a person who is appointed to care for the well-being of the ward, or the person who the guardianship applies to. This might include things like providing care, making medical decisions, finding and placing the ward in suitable living arrangements, and participating in regular visits with the ward. A guardian of the estate is the person who is responsible for the ward’s financial affairs. This may include filing tax returns, paying bills, maintaining financial records, and handling any outstanding debts or investments on the ward’s behalf. A limited guardianship is a guardianship that grants a guardian only certain rights and duties; only the areas of the ward’s life deemed necessary by the court are placed under guardianship, and the guardian has no authority in any other areas. This type of guardianship is typically used when the ward is considered fully able to make some decisions, but the court has determined that a guardian is necessary in certain areas. No matter what type of guardianship is put in place, the ward retains all of their rights and privileges to the extent allowed by law, including the right to vote, own property, and enter into contracts. The guardian is responsible for making decisions that benefit the ward, and must always act in the best interests of the ward.
