What is the process for transferring guardianship?
In Ohio, the process for transferring guardianship involves petitioning the court. It begins by filing a petition with the court in the county the proposed new guardian lives. The current guardian must be given notice of the filing and be provided an opportunity to attend the hearing. The court will then consider the petition and may hold a hearing if necessary. The court will then enter an order as to whether or not it is in the best interest of the ward to transfer the guardianship. If the court approves the transfer of guardianship, the current guardian must sign an Acceptance of Transfer of Guardianship and Notice of Transfer of Guardianship. This document must be filed with the court. The new guardian also has to file a Financial Report, an Appraiser’s Report, and a Bond, when required. Once all documents are filed with the court, the court will then enter a final order transferring guardianship. The order will specify the responsibilities and authority of the new guardian. It is important for the guardian to seek legal advice before agreeing to take on any legal obligation or responsibility.
