How are guardianship decisions made?

Guardianship decisions in Florida are made by the court when it is deemed necessary for someone who is unable to make decisions for themselves due to a disability or other issue. A guardian will be appointed by the court to make decisions related to the physical, financial, psychological and emotional wellbeing of the person in need of a guardian. In order to make a guardianship decision, the court will look at a variety of factors. First, the court will look to see if any family members are willing and able to provide care for the individual in need of a guardian. If not, it will look for other potential guardians who can legally provide guardianship. These include friends, relatives, or professionals. Once a potential guardian is identified, the court will assess whether the guardian has the necessary skills, experience, and training to provide the best care for the individual. They will also consider if the guardian is available and willing to provide care. Lastly, the court will consider the best interests of the individual when making their guardianship decision. The court is ultimately responsible for determining who will be appointed as the guardian and can change or revoke guardianship if necessary. Additionally, the court can also set limits on the type of decisions the guardian is able to make. Ultimately, the court must always look out for the best interests of the individual when making a guardianship decision.
