How are guardianship decisions made?

In New Hampshire, guardianship decisions are made through the court system. Generally, a judge will review the facts of each case and make a decision based on the best interests of the ward (person for whom a guardian is being appointed). To determine the ward’s best interests, the court will consider several factors, including the proposed guardianship arrangement, the ward’s wishes, and the ward’s physical and mental health. In addition, the court may look at the ward’s job skills and income, their living arrangements, and any public or private assistance the ward may be receiving. The court may also consider whether the proposed guardianship arrangement is the least restrictive appropriate to protect the ward’s health and safety. This means that the court will examine whether less restrictive alternatives, such as conservatorship, guardianship of the estate, or power of attorney, could adequately protect the ward. Ultimately, the court’s decision is based on a thorough assessment of the ward’s situation and the proposed arrangement. The court must be satisfied that the proposed arrangement will protect the ward’s safety and best interests. The court may also impose additional safeguards, such as requiring the guardian to report regularly to the court, in order to ensure that the guardianship continues to be in the ward’s best interest.
