What is a guardianship for an adult?

A guardianship for an adult is a legal arrangement in which one or more persons are appointed by a court in California to look after the physical, personal, and financial matters of an adult who is deemed to be incompetent. This usually applies to those adults who can no longer make decisions for themselves due to a mental impairment, physical incapacity, or age. An adult guardianship grants the appointed guardian with the authority to make decisions on behalf of the adult in need of protection. The guardian has a number of responsibilities including providing food, shelter, medical care, and assisting with financial affairs, such as overseeing bills and taxes. They are also responsible for making sure the adult is safe and well-cared for in their environment. The guardian will usually make visits to the ward regularly and keep meticulous records of all decisions and activities. Guardianships can be established for a variety of reasons. It can be requested by the adult’s family, a doctor or a member of the community, or it can be established by the court if there is evidence that an adult is no longer able to make decisions for themselves and/or is in danger of being taken advantage of. The guardian is appointed to act in the best interests of the individual and must serve the adult’s interests before their own.
